Second Bail Application Rejected for Suspects in AKA and Tibz Murder Case

The Durban Magistrate’s Court denied a renewed bail application on Wednesday from two suspects involved in the infamous murders of rapper Kiernan “AKA” Forbes and Tebello “Tibz” Motsoane.

Mziwethemba Harvey Gwabeni and Lindokuhle Ndimande requested bail, citing their families’ financial and emotional struggles due to their imprisonment. They argued that the State’s investigation had concluded, leaving no reason for their continued detention, and assured the court that they would refrain from interfering with any witnesses.

Magistrate Vincent Hlatshwayo rejected their plea, indicating that there was insufficient new evidence to warrant granting bail.

Hlatshwayo stated, “The information before me is not novel. The first accused has a record of witness interference, and there is no strong evidence suggesting this will not happen again.”

Extradition and Related Charges

The defendants also mentioned the Ndimande brothers, Siyabonga Gezani and Malusi Dave, who are allegedly connected to the murders but are currently in Eswatini, resisting extradition to South Africa.

Gwabeni and Ndimande, alongside Lindani Zenzele Ndimande, Siyanda Eddie Myeza, and Lindokuhle Lindo Ndimande, face multiple charges, including:

  • Conspiracy to commit murder
  • Murder
  • Unlawful possession of firearms and ammunition
  • Five counts of attempted murder
  • Money laundering

According to the State, Gwabeni orchestrated the murder scheme, receiving R800,000 and allocating funds among his co-accused.
